Officer not charged in domestic violence investigation

UNION-TRIBUNE BREAKING NEWS TEAM

11:36 a.m. August 25, 2008

OCEANSIDE – The Oceanside police lieutenant recently arrested on suspicion of domestic violence and battery has not been charged with a crime and an arraignment date scheduled for Monday in Superior Court has been postponed, officials said.

Lt. Shawn Murray was arrested at his Carlsbad home on Flat Rock Street, near Rock Ridge Road, after his ex-girlfriend called police Aug. 17 to report she had been choked and dragged at his home, according to police.

Paul Levikow, a district attorney spokesman, said Murray posted $25,000 bail and has not been charged by the District Attorney's Office.

Since Murray posted bail, prosecutors do not have a deadline to decide when to file charges, Levikow said. It is unknown when they will make a decision on the case as they are still reviewing it, he said.

Officers who went to the home said the woman's throat was red, which led to Murray's arrest, Carlsbad police Lt. Kelly Cain said previously.

The woman declined treatment after the incident.

Murray's duties as a lieutenant included overseeing the traffic division, school resource officers and neighborhood police officers in downtown Oceanside. He has been assigned to do administrative work pending the outcome of the investigation and the judicial process, according to Oceanside police.
